Constitutional Law Expert - Armenia Should Not Attach Provisos to Protocols

Constitutional law expert Vardan Poghosyan stated today that it was not acceptable practice for a nation to declare "provisios" when it came to a bilateral treaty. "There is such a practice regarding multi-national treaties but not in bilateral agreements," stated Mr. Pohgosyan, referring to the recent decision of the RoA Constitutional Court regarding the constitutionality of the Armenia-Turkey Protocols.

"Such a move is ridiculous. Just imagine there are two parties to a contract and that one of them goes home after signing a document and a few hours later declares, ‘I agree in principle but I’d like to include certain stipulations as to Point X’. Such concerns should have been ironed out before hand," argued Mr. Poghosyan. The legal expert added that the National Assembly could declare reservations but that such a move wouldn’t be in the best interests for Armenia. "We would be going down the same road as Turkey. Here, I refer to the statement of Erdogan that they require certain provisions; that the issue must be linked to Karabakh. In my opinion, we should have no such provisos," he stated.
