Charges that reporter verbally abused judge not backed up by court tapes

veziryanToday, at the Kentron and Nork-Marash District Court, Judge Gagik Poghosyan presiding, the case of "Chorrord Ishkhanutyun" reporter Gohar Veziryan was being heard. The testimony of four witnesses, all officers of the court, was heard. - Doesn't the interrogation of the witnesses interest you? Why are you reading a newspaper? - the judge asked Gohar Veziryan. - No, it doesn't interest me. - I forbid you to read the papers during the trial. If you continue to do so I will regard it as behavior disrespectful of the court. I hope you are aware of what the consequences would be in that case. - No, I am not familiar with the consequences, - Ms. Veziryan retorted and continued to read, but this time it was criminal case material. She didn't seek to question any of the witnesses. 18_04-veziryan1Reporter Gohar Veziryan is being charged with that very crime, "behavior disrespectful to the court". At the core of the indictment is the testimony of witnesses Shahen Ohanyan, Artur Pilosyan, Rafael Stepanyan and Murad Grigoryan. On the day of the incident, while removing Gohar from the court for "disrespectful behavior", they escorted to the use of physical force. Even though the court physician registered the traces, he didn't evaluate their severity in his report. All the while, inspector Gayaneh Yeritsyan found that the conduct of the court officers was justified and proper. 18_04-g-veziryanThe incident in question took place on August 6, 2008, during the trial of Smbad Ayvazyan. Even though the court was packed with people, the only ones who heard Gohar's alleged verbal abuse directed at Judge Gagik Avetisyan were the court secretary, Hasmik Jalalyan, and the court officers. Thus, they were the only ones called to testify. During the last trial session Hasmik Jalalyan, stated that on the day in question Judge Gagik Avetisyan ordered Ms. Veziryan to stand because she was talking to the court officers. Because she refused to do so, she was thus removed from the courtroom. In the words of Hasmik Jalalyan, when she reached the door Ms. Veziryan blurted out, "you once were decent people, what are you doing with this uncouth lout?" Ms. Jalalyan believes that these words were addressed to the judge. Today the witnesses testified that Judge Avetisyan removed Gohar Veziryan from the court for not following his directive that reporters not tape record the proceedings. "All the other reporters followed the directive, but Veziryan continued to tape record. Judge Avetisyan told her to stand up, but Veziryan failed to comply and started to argue with the judge stating - who are you that I should stand up, I've already stood up once -" stated court officer Shahen Ohanyan. The witness specifically noted that the reporter called the judge a "psychophrenic" and a "minion". Defense attorney Hovik Arsenyan asked why the court officer didn't make such a statement to the court investigator on August 11. However, Judge Gagik Pogosyan threw the question out arguing that "such materials couldn’t be used as evidence since they haven't been studied by the court". The other witness, Artur Pilosyan, also noted that Ms. Veziryan raised her hand in the direction of Judge Avetisyan and said - hey you psychophrenic, underling, who are you to order me to stand. He then said that the reporter started to curse the judge when she got to the door. The defense attorney inquired why then do such phrases not show up in the court recordings. "I don't know what the technology is but there were words that Veziryan shouted out, so that all could hear. But she also spoke some words very softly. Perhaps this is why they weren't recorded," stated Chief Court Officer A. Pilosyan and added, "But me and my guys heard what she said." After his testimony, defense attorney Hovik Arsenyan gave up on cross-examining the other two witnesses due to "the described virtual reality". However, the defense attorney requested that court officer Murad Grigoryan answer the following question on his honor as a man, "did the investigator give you the testimony of any of the witnesses during the preliminary examination for you to copy?" "No", answered Mr. Grigoryan. However, according to Hovik Arsenyan, the preliminary testimonies are the literally the same as well as in terms of punctuation marks. Gohar Veziryan then requested an adjournment because "new evidence has been presented by the witnesses". The trial will continue on April 28.
