Head and Chief Accountant of the Company Sentenced
The RA General Prosecutor's Office had informed that the State Interests' Protection Department of the RA General Prosecutor's Office initiated a criminal case by the materials received from the Control Chamber on the abuse of official authorities by the head of the "Hayhydromet" State non-commercial organization.
In order to provide the society with the full information on the judicial process it is informed that the Court of First Instance grounded the accusations brought by the prosecutor against H. Vardanyan and the chief accountant V. Torozyan.
The Court found that the head of "Kamar" CJSC H. Vardanyan after receiving 153,0 million drams on July 28, 2006 for the purchase of a "Hydrological special ship for the needs of the State" and knowing that the trawler "BPM-74 M-JD" offered by the Russian "Akhtarskaya Soudoverf" CJSC which cost 46.923.200 drams equivalent to 3,2 million RUB did not correspond to the technical description of the agreement, in the cost calculation presented to the "State Procurement Agency" State non-commercial organization mentioned 99,0 million drams as the price of the trawler.
Later, he included false data in the modification, renovation and transfer documents and on March 16, 2007 gave to the RA Ministry of Nature Protection the trawler "BPM-74 M-JD" which did not correspond to the technical description of the agreement and by the help of the chief accountant of the "Kamar" CJSC V. Torozyan squandered 33.559.963 drams from the State Budget.
S. Mayilyan, the head of the Administrative and Financial division of the RA Ministry of Nature Protection and the Division responsible for the purchase of the hydrological ship in the framework of the project "Hydro-meteorological Monitoring in Lake Sevan and its basin" and having authority of the supervisor of the client failed to perform his official duties and without examining the documents confirmed the conclusion N 06-88-1-E presented on March 16, 2007 by the head of the "Hayhydromet" State non-commercial organization that the ship purchased by the "Kamar" CJSC by 153,0 million drams corresponded to the technical character of the agreement though the a trawler "BPM-74 M-JD" didn't correspond to the technical points included in the purchase agreement. As a result of this the ship was admitted by the RA Ministry of Nature Protection.
H. Vardanyan admitted his guilt and the squandered 33.559.630 drams was recovered.
On May 11, 2011 the Court of First Instance of Arabkir and Kanaker-Zeytun administrative districts found H. Vardanyan guilty according to the RA Criminal Code Articles 178, part 3, point 1 and sentenced him to 4 years and 6 months of imprisonment. V. Torozyan was found guilty according to the RA Criminal Code Articles 38-178, part 3, point 1 and sentenced to 4 years of imprisonment. In January 2011, the criminal persecution against S. Mayilyan was stopped based on the amnesty act.
