Kocharyan's Lawyers File Complaint with ECHR; Claim Ex-Prez Deprived of Fair Trial

The defense team of former Armenian President Robert Kocharyan has filed a case with the European Court of Human Rights (ECHR), saying their client’s right to a fair trial and the presumption of innocence has been violated in Armenia.

Kocharyan, the outgoing president in 2008, was charged on July 26 of this year of usurping state power to quell the mass protests that followed the contested February 2008 presidential election that ushered in the ten-year reign of Serzh Sargsyan as president.

Kocharyan had been slapped with a two-month detention order that was later overturned by the Court of Appeals on August 13. The court determined that he cannot be prosecuted for the March 1, 2008 post- election violence in Yerevan that killed ten.

Kocharyan was   given the option of signing an affidavit promising not to flee Armenia during the court case that appears to have stalled given political developments in the country.
