Armenian Parliament to Discuss Amendments to State of Emergency Law

The Armenian National Assembly, at the suggestion of the government, will convene a special sitting on April 28 to discuss amendments to the Law on the State of Emergency, the Labor Code, and the Law on the State Budget for 2020.

The draft law on the state of emergency proposes to stipulate that by the decision of the government, the Prime Minister, or the Deputy Prime Minister defined by that decision, officially acts as a guardian of the state of emergency during the state of emergency.

The Head (Commander) of the State of Emergency Command carries out the joint management of the forces and means of ensuring the legal regime of the state of emergency, as well as coordinates the implementation of measures applied in the conditions of the state of emergency.

In order to exercise the powers defined in this part, the Commander may adopt by-laws or sub-legislative acts of the Prime Minister or Deputy Prime Minister.

The proposal, however, calls into question the legitimacy of the decisions made by the Commander. It should be reminded that at the previous special sitting MP Edmon Marukyan said that the commander is not authorized to adopt relevant legal acts. Rather, they should be adopted by the decisions of the government.

Commander Tigran Avinyan responded that the law "On the Legal Regime of the State of Emergency" has a number of gaps from a legal point of view and  needs to be amended.
