"Hetq" had previously reported that the RoA Administrative Court rejected a suit filed by a number of environmental and civic organizations protesting the felling of the Teghut Forest due to mining operations there. The court argued that the plaintiffs, as NGO's, were not legally authorized to debate such ecological issues.
Hayk Alumyan, attorney for the plaintiffs, has informed "Hetq" that they will file a protest with the court regarding its rejection of the suit.
The plaintiffs will claim that based on the Aarhus Convention, which grants the public rights regarding access to information, public participation and access to justice, in governmental decision-making processes on matters concerning the local, national and trans-boundary environment, the court must recognize their organizations as the "interested public".
The plaintiffs, "Transparency International Anti-Corruption Center", "Helsinki Civilian Assembly Vanadzor Office" and "Egodar NGO", are calling for the court to put a halt to the mine at Teghut, arguing that the local environment will be irreparably damaged as a result.
