Administrative Court Overruled; Must Hear "Teghut Defense Group" Suit
The RoA Court of Cassation has thrown out the ruling of the Administrative Court denying the Teghut Defense Group from entering a legal suit calling for a halt to mining activities in the endangered forested area in Tavush Marz, according to attorney Hayk Alumyan. The lower court based its ruling on the argument that the Teghut Group wasn’t "qualified" to mount such legal action.
Attorney Alumyan told "Hetq" that the courts must now hear the environmentalists’ claims that mining operations will cause irreparable damage to the area and that the mining permit process itself was flawed. He stated that the Court of Cassation was forced to find in favour of the environmentalists because they had petitioned all appropriate bodies as set forth by the Aarhus Convention regarding public disclosure. Heritage Party MP Zaruhi Postanjyan had also raised the issue at various PACE sessions and had urged deputies to take appropriate action.
