Constitutional Law Expert - Protocols Will Probably Pass the Test
On January 13, the RoA Constitutional Court is scheduled to rule on the constitutionality of the Armenian-Turkish Protocols.
Constitutional law specialist Hrayr Tovmasyan today stated that, “There is no overt unconstitutionality when the protocols are simply compared to the constitution, but there can be an argument made for such a case when the protocols are interpreted. In particular, such a sticking point can be linked to the so-called historical committee and questioning the reality of the Genocide. If the committee has such a mandate, then there is an argument to be made regarding unconstitutionality.”
Mr. Tovmasyan stated that in all likelihood the Court would not find any legal objections in the Protocols. The Turkish Parliament has already reviewed the document. The Armenian National Assembly is waiting for the Constitutional Court’s ruling before doing the same.
