Wikileaks and RA General Prosecutor’s Office
In order to provide full and comprehensive information to the public and taking into consideration the public interest concerning the information spread by Wikileaks web-site about the meeting of the RA Prosecutor General with the US Ambassador to Yerevan and other diplomats as well as about the employees of the RA General Prosecutor’s Office concerning the statements about trafficking victims, it is informed that the RA General Prosecutor’s Office has carried out large-scale works aimed at increasing the effectiveness of struggle against trafficking and illegal migration in our country.
On June 8, 2005 by the order of the RA Prosecutor General a special sub-division of struggle against trafficking and illegal migration was formed within the Investigation Department of the RA General Prosecutor’s Office which investigated the criminal cases initiated on trafficking.
During the second stage of the legal reforms the investigation department was removed from the system of the RA General Prosecutor’s Office as a result of which the criminal cases initiated on trafficking were investigated by the territorial and community investigation divisions of the RA Police.
In order to recover the practice of centralized investigation of the mentioned crimes, the RA Prosecutor General tasked to form a division of trafficking, illegal turnover of narcotic drugs and organized crimes within the General Investigation Department of the RA Police.
During the second stage of the legal reforms by the order of the RA Prosecutor General on November 30, 2007 the Department for Crimes against the Individual was formed in the RA General Prosecutor’s Office which was to supervise the preliminary investigation of the criminal cases initiated on trafficking.
As a result of consistent work carried out by the RA General Prosecutor’s Office Armenia moved from the 3rd to the 2nd category of the special control countries of the struggle against trafficking mentioned in the annual report of the US State Department.
Concerning the information given to the US diplomats by the prostitutes that the employee of the RA General Prosecutor’s Office A.Yeremyan committed violations, it is informed that at that time the RA Prosecutor General tasked to conduct investigation, a interdepartmental committee was formed and all the appeals were checked which were not confirmed based on the conclusions of the interdepartmental committee and the results of the investigation.
The RA General Prosecutor’s Office signifies the cooperation with the international organizations and NGOs as well as the training of the prosecutors in the field of the struggle against trafficking.
In 2008 the RA Prosecutor General tasked to carry out the following:
In January 2008 the Department for Crimes against the Individual of the RA General Prosecutor’s Office organized the participation of the prosecutors of Yerevan, Ararat, Armavir and Kotayk in the training organized by the “Hope and Assistance” NGO in the framework of the “The Cooperation between the NGOs and Governments in Southern Caucasus and the development of mutual responsibility against the trafficking in women and children” regional program held on January 23, 24, 30 and 31 in “Aviatrans” hotel in Yerevan.
On February 7 and 8, 2008 in the “Congress” hotel in Yerevan the RA General Prosecutor’s Office organized the seminar on the international cooperation in criminal matters together with the OSCE office in Yerevan and ODIHR.
From March 27 to March 29, 2008 the prosecutors of the Department for Crimes against the Individual of the RA General Prosecutor’s Office participated in the trainings organized by the “Hope and Assistance” NGO and “European Commission” in the framework of the program “The Cooperation between the NGOs and Governments in Southern Caucasus and the development of mutual responsibility against the trafficking in women and children” and presented the main problems of the procedural protection of the victims of trafficking, the international legal regulations concerning the compensation to the victims as well as the analysis of the trafficking crimes in the RA Criminal Code and the differentiation from the related institutes.
From May 26 to June 7, 2008 the Department for Crimes against the Individual of the RA General Prosecutor’s Office organized the participation of the prosecutors of Yerevan, Ararat, Aragatsotn, Gegharkunik, Tavush, Synuk and Vayots Dzor in the sessions devoted to the main problems of the struggle against trafficking organized by the UMCOR office in Armenia in the framework of the program “In answer to the strengthening the abilities of the law enforcement bodies in the struggle against trafficking”. The prosecutors also had meetings with a group of experts working in this field.
A lecture on “The legal means of the struggle against trafficking” is delivered during the annual trainings of the prosecutors in the “Prosecutor’s school” SNCO.
In 2009 the RA General Prosecutor’s Office implemented the following works aimed at the struggle against trafficking.
In May, 2009 the employee of the Department for Crimes against the Individual of the RA General Prosecutor’s Office participated as an expert in the training-seminar organized by the UN International Labor Organization and the “Hope and Assistance” NGO for the judges, prosecutors, investigators and the employees of the State Labor Inspectorate in the regions of the Republic of Armenia.
From April 27 to 30, 2009 the representative of the Department for Crimes against the Individual of the RA General Prosecutor’s Office participated in the seminar on “Juvenile Justice” in Tbilisi.
The representative of the RA General Prosecutor’s Office participated in the working group and subgroup adjunct to the council on trafficking in Armenia which the prepares the package of the projects on legislative amendments and additions concerning trafficking.
From January 21 to 25, 2010 the head of the Department for Crimes against the Individual of the RA General Prosecutor’s Office V.Shahinyan participated in the round-table discussions on “Juvenile Justice in South-Eastern Europe and European Neighborhood Policy Countries” held in Brussels Belgium.
The prosecutor of the Department for Crimes against the Individual of the RA General Prosecutor’s Office A.Ghambaryan participated in the works of the working group and subgroup adjunct to the council on trafficking in Armenia which the prepares the package of the projects on legislative amendments and additions concerning trafficking.
From March 20 to April 10, 2010 the deputy head of the Department for Crimes against the Individual of the RA General Prosecutor’s Office Arthur Davtyan and the prosecutor of the same department Arthur Ghambaryan participated in the visit on “Cooperation in the field of struggle against trafficking” organized in the framework of the US Embassy program on the struggle against narcotic drugs and legal cooperation.
On February 27, 2010 the senior prosecutor of the department A.Marukhyan participated in the computer training on the struggle against narcotic drugs, human trafficking, money laundering and other transnational organized crimes organized by the UNDP.
From April 14 to 24, 2010 the prosecutor of the department V. Hovhannisyan participated in the seminar on “The Protection of the Rights of the Accused in the Criminal Procedure” held in California, USA.
On May 14, 2010 the senior prosecutor of the department A. Marukhyan participated in the seminar on “The Reaction of the Criminal Justice to the Trafficking in Humans and its Relations to the Transnational Organized Crimes” organized by the UN Department of Public Information of the RA Ministry of Foreign Affairs and the UN office.
From October 17 to 22, 2010 the deputy head of the department A.Davtyan participated in the 5th session of the UN Convention member states on the struggle against Transnational Organized Crimes held in Vienna.
Statistics
During 2008 preliminary investigations of 15 criminal cases initiated on trafficking were carried out, 12 cases according to the RA Criminal Code Articles 132, 1321 and 2 cases according to the RA Criminal Code Article 166.
In 2008, 5 criminal cases against 9 persons were sent to the Court. In the framework of 3 criminal cases the accused were sentenced to up to 7,6 years of imprisonment.
During 2009, 21 criminal cases were investigated in the General Investigation Department of the RA Police according to the RA Criminal Code Articles132, 1321 and 168.
In 2009, 11 criminal cases against 16 persons were sent to the Court. In the framework of 8 criminal cases the accused were sentenced to up to 13-14 years of imprisonment.
In 2010, the Department for Crimes against the Individual of the RA General Prosecutor’s Office supervised the preliminary investigation of 13 criminal cases initiated according to the RA Criminal Code Articles132 and 1321. 4 criminal cases against 6 persons were sent to the Court, 2 cases were suspended, 3 cases were merged to other criminal cases and the preliminary investigation of 4 criminal cases is still being carried out. 9 women were accused in the framework of the above-mentioned criminal cases.
The RA General Prosecutor’s Office has always presented the implemented works and their results publicly and if it is acceptable for the diplomats to express gratitude for the implemented works and to mention just the opposite in the reports, this circumstance is not acceptable for the interpretations of the General Prosecutor's Office.
The RA General Prosecutor's Office always informs about the results stated by the conducted works and the statistics of the struggle against the criminality.
